Editor's Note - The following story presumably involving this same James Walter Callaway, was also provided by Bud Keeton. It is a story from a dark and troubled time.

"BURNING OF GILES, A SLAVE"
In 1858 Simeon Thornhill and his family lived near the center of Section 20, in Township 49 north, Range 1 east, being north of [and] east of Troy, [Mo.] and about three and one half miles distant therefrom on a straight line. Thornhill was the owner of a slave named Giles, and when he and his slave were both sober they were on as good terms as generally existed between a slaveholder and his servant. In those days the greater part of goods sold at Troy were hauled on wagons from the landing at Cap-au-Gris, on the Mississippi [about 18 miles]. One of the leading articles thus conveyed was whisky, and it was customary with the drivers of the teams hauling it out from the river to carry gimlets with them with which they tapped the barrels, and by the use of a straw, sucked therefrom, to their full satisfaction, the death-producing liquid. Thornhill and his slave frequently hauled goods from Cap-au-Gris to Troy, and indulged according to the custom, and also usually carried home a jug of the "ardent." Giles was allowed to have whisky whenever he could procure it, and as it was both cheap and free in those times he had no difficulty in obtaining it. It is said by a prominent citizen, who lived in the Thornhill neighborhood, and who was well acquainted with the parties, that when Thornhill had a jug of whisky Giles always had a share of the contents, and visa versa, when the slave had whisky he always divided with his master, and thus they mutually imbibed.

On the night of December 24, 1858, they were together in the negro's cabin, which was enclosed in a little yard near the residence of Thornhill. Here they were drinking. The hours "wore away," and all retired for their usual rest save the master and his slave, who continued to indulge in the dangerous amusement. Presently they disagreed, then grew angry, became desperate, and the negro, being the larger and stronger man, made a pass at his master, who fled for safety toward the house. The negro caught him while crossing the yard fence, and with his knife stabbed him in several places, mostly on the back of his body, but did not kill him instantly. This aroused the sleepers, and Thornhill was carried into his house and cared for. The next day (Christmas) the negro was arrested without process of law and placed in jail at Troy. Capt. Jordan S. Salle, who still resides in Troy (and to whom the writer is indebted for some of these facts), was then the jailer. Some of the neighbors of Thornhill, and others residing east of the Cuivre, became terribly incensed at the negro, and in a few days after he was incarcerated in jail they assembled and started toward Troy, for the purpose of lynching him and putting an end to his existence; but upon reaching the river they found that it had so swollen that they could not cross, and thereupon disbanded and returned to their homes. Thornhill lingered until the 30th of the month, and then died from the effects of the wounds inflicted by his slave. On the following day Capt. Salle, the jailer, anticipating the action of the mob, and being anxious to have a legal right to hold his prisoner, in case of a demand for his release or an attack upon the jail, filed his affidavit with Charles Wheeler, a justice of the peace, charging Giles with the murder of Thornhill. In the affidavit he stated that on the day that the negro was delivered into his custody he "acknowledged that he had stabbed his master, Simeon Thornhill, several times on the night before, and that he tried his best to kill him, and would have cut his head off and cut him in two if he had had anything to have done it with at the time."

A warrant for the formal arrest of Giles was then issued by Squire Wheeler. The prisoner was taken before this officer and given a preliminary trial, during which he (Giles) stated that he and Thornhill were both drinking when the difficulty took place, and that Thornhill threatened several times to kill him, and did actually stab him first. Upon the evidence adduced at this trial he was legally admitted to jail, and thus the jailer obtained a legal right to hold him.

On the second day after Thornhill died, it being January 1, 1859, the mob re-assembled and went in a body to Troy. A little after noon James Callaway stepped on a "Horse Block" near where Mr. Hart's store now stands, and made a short speech to the crowd there assembled. They then started, yelling, on the way toward the jail. Arriving there they demanded of Capt. Salle the keys, but he, very properly, refused to give them up. Runners then started down town for tools with which to break down the doors. The tools being brought the doors were finally broken down, the negro was taken out, and his feet were chained to a stake driven into the ground in the jail yard, and his hands were tied behind him. The irate members of the mob, in haste and with a seeming relish and delight, piled wood around the wretched and defenseless victim, and prepared to burn him alive. Here he stood in this awful condition, facing death with a brave and unnatural courage--confessed his crime and repented not, but told his executioners that when he committed the crime he was drunk, otherwise he would not have done it, and that they, being sober, ought not thus to take his life in retaliation.

When the funeral pile was completed, it was set on fire. The fuel being dry, the lurid flames enwrapped the victim, yet minutes passed ere death ensued. But death did not satisfy the wreakers of the vengeance. They added fuel to the flame, and stirred up the fire, and persevered in the fiendish work until the body was all reduced to ashes. It is said that the scene was horrible to behold.

On this lamented occasion, many spectators, who neither approved of the act, nor rendered any assistance to the perpetrators thereof, assembled to witness the burning, while others, who came into town for the purpose of witnessing the scene, considered the cruelty and enormity of the crime, and went away without seeing it. Perhaps the most remarkable thing in connection with the matter was the indifference manifested in the conduct of the negro--the stolid demeanor in which he met his death---the fact that he confessed his crime, yet expressed no sorrow for it, but entered into eternity defiant and unrepentant. By what method of reasoning can anyone account for such unnatural conduct! And it may be asked with propriety, by what method of reasoning can anyone account for the cruel and illegal conduct of the men who burned the negro at the stake!

On the 25th day of March, 1859, three of the leaders of the mob, James Callaway, James Segrass, and Samuel Carter, were indicted for the murder of Giles, the slave. At the following fall term of the Lincoln Circuit Court they were arraigned for trial, and Thomas P. Hoy was appointed circuit attorney pro tem. to prosecute them. On being arraigned they plead "not guilty." The following jurors were then empanelled, and sworn to try the defendants: James H. Reeds, Smith McGinnis, D. H. Chambers, G. W. Stonebraker, John W. Rice, Gabriel Thompson, Charles Kimler, William Hopkins, Zach. Lovelace, William Birch, Gion G. Wilson and James Horton. At this stage of the proceedings the circuit attorney dismissed the case, and thus ended the prosecution. The burning of the negro has always been and is still regretted by the best people of Lincoln County. All countries have suffered from the practice of lynch law. While there are many citizens now in Lincoln County who resided here when this affair took place, it is said that not one of the members of the organized mob that perpetrated the act remains in the county; that nearly all of them died early in life, and that only one of them was known to be living at a recent date, and he was then residing in Taylor County, and is probably still living. He was one of the leaders.

In Memory

We are sorry to learn of the passing of Marsha Manley. Our thoughts and prayers go to her brother, Steve and all of his family.

Marsha Hughes Callaway Manley, a resident of Alpine since 2001, stepped on a rainbow Jan. 20 of a stroke.

She was born Sept. 11, 1945, in Houston. She was a mother, educator, friend and active community leader who enriched the lives of everyone she encountered.

She was educated at Stephen F. Austin University in Nacogdoches and the University of Houston, where she received her M.S. in education. From 1968 until her death she worked as a special education teacher and/or principal in several Texas cities.

She is survived by her children, Jason Manley of Brenham and Holli Manley of Austin; three grandchildren, Callaway, Camille and Cannon Manley, all of Brenham; two brothers, Steve Callaway of Tyler and Gary "Catfish" Callaway of Terlingua; and by a number of nieces, nephews and cousins. She was preceded in death by her son, Michael.

Memorial services are scheduled for Saturday, Jan. 27, at 2 p.m. at the First Presbyterian Church in Alpine with the Rev. Jobeth McLeod officiating.

In lieu of flowers, the family requests that donations in Marsha's name be made to your favorite charity.

Don't Miss the Fun in Atlanta

I would like to thank CFA Member, Fred Lucas for sending us this note about his visit to last year's CFA Meeting in Roanoke, VA. (Editor's Note - The 32nd Callaway Family Association Annual Meeting will be held in October 2007 in Atlanta, Georgia. More details to follow in upcoming newsletters.)

I went to the meeting in Roanoke and had a marvelous time. I saw a number of people that I hadn't seen for awhile. We had a marvelous time visiting the Virginia Transportation Museum, the Poplar Hill home of President Thomas Jefferson and the Railroad Restaurant in Bedford. Since my late parents Alice and Nathan Lucas lived in Radford for forty years, I found time to visit old friends there. The Blue Ridge mountains were stunning as we saw the trees change. When we visited Boston, we were known as leaf peepers.
 
I hope that as many as possible will come to the meeting in Atlanta. We should have fun. I'm a graduate of West Virginia University and a football fan. Do you remember what happened when West Virginia met the University of Georgia in the Sugar Bowl in 2006? WVU 38 the University of Georgia 35. This year in the Gator Bowl it was WVU 38 Georgia Tech 35. The WVU quarterback, a native of Alabama wanted to play there but he couldn't play quarterback . Speaking of Alabama, Neil Callaway was named head football coach at the University of Alabama Birmingham. He replaces Watson Brown. Neil is a native of Macon, Bibb Co., GA.
 
I am also a basketball fan. When I talk to Judy Ostler, I have to say wait until next time. During the 2005-2006 basketball season, WVU lost twice to the University of Texas her alma mater.

We have some remarkable new documentation thanks to the generosity of Gail Mosuch. She has long been searching for the proof that William Callaway, Jr. is William Callaway's son. Now she has it! She also could use some help in identifying all the people mentioned in these new documents. This line of descent is as follows:

I have found my William Sr., and William Jr. connection—I have a copy of the administration of the estate of William Sr. which was administered by Matthew in July 1763.  The following people received equal portions in cash—Elizabeth Callaway, John Callaway, Thomas Waller (Editor's Note -
Thomas Waller is daughter Jane Callaway’s husband), WILLIAM Callaway, Benjamin Callaway, Ann Callaway, Elisha Hearn (Editor's Note - Elisha Hearn is daughter Elizabeth Day Callaway’s son), and Elizabeth Callaway, widow received a larger portion. Son Moses, is not listed but he received property in the will—I believe Elisha is a grandson and maybe Thomas Waller is  a son-in law (husband of Jane?). But who is ANN? I have not seen her listed anywhere else as a child of William-but looks as if she may be.

I also have a copy of the settlement of the estate of Elizabeth Callaway in  March 1763. administered by Peter Callaway.

Receiving equal amounts were John, William, Thomas, Matthew and Elizabeth Callaway. Who is this Elizabeth and which Peter is this?  This estate was administered Before the one mentioned above. My brain is rattled!

In the month of September, 1876, occurred an election for State Officers. William R. Miller was the Democratic candidate for Governor, and General A. W. Bishop the Republican candidate. The entire vote cast was 108, 633. Mr. Miller received 70,425 votes, and General Bishop, 38, 208. The other State officers elected were B. B. Beavers, Secretary of State; John Crawford, Auditor; Thomas J. Churchill, Treasurer; W. F. Henderson, Attorney-General; J. N. Smithee, Commissioner of State Lands; George W. Greetings from snowy and frigid Toronto, Canada. John STONE (1713 - 1803) was born in Leigh, in the parish of Yetminster, Dorset, England, a son of Thomas and Elizabeth STONE. Lydia KELLAWAY was born in Piddlehinton, Dorset, in 1740, a daughter of John and Sarah KELLAWAY. In 1763, John STONE of Sydling and Lydia KELLAWAY were married in Piddlehinton church, in the presence of Ann KELLAWAY and John WEBBER. John and Lydia lived in Sydling, Piddlehinton and elsewhere in Dorset and they had issue:

1. Thomas STONE, born in 1766, who married Grace PAUL in Yetminster in 1793. They lived in Chelbury and they had issue.

2. John STONE, born about 1771, who married Mary EARS in 1793 in Holwell, Dorset. They apparently lived in Piddlehinton and in Leigh and they had issue.

3. Sarah STONE, born in 1773 in Piddlehinton, Dorset, who married John CHAMMEN / CHAMEN, in Piddlehinton in 1793, in the presence of Jasper ROGERS and John STONE. They lived in Piddlehinton and elsewhere in Dorset and they had issue.

4. Henry STONE, born about 1776, who married Jane TIZARD in Piddlehinton, in 1798, in the presence of Elizabeth BARTON, Mary Ann BROWNE and Elizabeth ROPER. They farmed in Piddlehinton, where Henry was a yeoman and occasional churchwarden and where they had issue.

The death of Mr Thomas KELLAWAY, an old North Queensland resident, took place at St Helen's Private Hospital last week. Mr KELLAWAY was a native of Tasmania, and came from an old family in the South of England, which gave to the England of the pre-Empire days gallant souls who won distinction on sea and land. He left Tasmania for Australia when a lad, and entered the service of the Bank of New South Wales. In the late seventies he was stationed at Cooktown, and was there a prominent figure in all athletic movements, being a young fellow of splendid physique. He opened branches of the Bank of New South Wales at various Northern towns, and was the pioneer of the institution at Croydon. Of late years Mr KELLAWAY has carried on business as an assayer, and was associated with many of the mining developments in Croydon. Recently he came to Brisbane for medical treatment, and entered St. Helen's, where Dr. JACKSON soon discovered that the case offered little hope. The deceased was a brother of Mr E B KELLAWAY of this city, and though known to but few in Brisbane, leaves a wide circle of warm friends in the far North.

I would like to thank Shirley Whipple for sending us the following article about Jesse Calloway. Can anyone identify him? He is a "Mystery Callaway".

Hi Donna,
I'm not sure 'who' Jesse was or what line he belonged to. It just caught my eye because I remembered a 'story' that my ancestor, Katie Paul, was gravely ill with tuberculosis and that Nathan uprooted his young family from their homestead in the Dayton/Walla Walla area and took them to the Spangle, Spokane county area of Washington.
 
The idea of bringing her there was so she could get medical help. My source was very vague and couldn't remember the particulars of how she was to receive help. She (my grandmother) thought that her grandfather took Katie there because Nathan's uncle or uncle's cousin was a physician. I told you this story before I think.
 
Where Nathan and Katie lived was an old farm owned by J.D or J.C. Callaway. Somewhere there is information that indicates that J. Callaway was a one time physician I think. I never could unravel the story and gave up trying. Nathan farmed for Callaway until Katie died. At that point he took off and started another homestead in the Big Bend area. Here he also worked for other farmers in a wheat threshing operation.
 
Nearby the old Callaway place was a newer and very impressive two story brick home. This was where J.D. or J.C. Callaway moved. He left the nephew to farm the old place. I don't think either party held up their end of the bargain or felt it had been held up.
 
But I think that J.D. or J.C. Callaway and this Jesse Calloway can't be connected, can they? I'm not sure who Jesse Callaway is and I was hoping you might have a clue. It would be nice to figure out if the 'physician'/nephew story has any truth to it.
 
I know that there was a tuberculosis hospital in Spokane around that time. Also, the hospital where Jesse Calloway ended up was the county poor farm called Broadacres. It was, apparently, used as a tuberculosis hospital at some point, but think it was after Katie's death. Katie died in 1901 and was buried about a half mile from Broadacres farm in the Spangle cemetery. In 1937 her body was exhumed and taken to the Dayton Cemetery, in the area where she grew up and spent the majority of her life.
 
Sad story all the way around. I don't know who J.D. or J.C. was for sure, but an old timer of the area said he was a physician, that he lost his two farms and that he ended up at the Poor Farm (Broadacres). I always thought J.D. or J.C. was Verlinda Callaway's youngest brother.

Another thought on this is that the article was dated 1896. And Katie died 5 years later. But Katie and Nate left Dayton prior to all this. Maybe this fellow was connected. I think I heard that Nathan was supposed to farm the place and keep the old man from losing it and the old man was to care for Katie. It's a stretch of the imagination isn't it?

I'm not sure if there was any truth in this story at all, but there has to be something to it because I got different versions. And the 1907 plat map clearly shows that there was SOMEONE named J. Callaway owning the property where Nathan and Katie stayed/farmed. The newer property where Callaway bought and built his brick home was further west.
 
But again, this Jesse Calloway looks like he wasn't long for the world in 1896. ????????? Genealogy is so confusing. Gotta laugh at yourself sometimes and wonder why it even matters.
 
Well if you figure out who Jesse was please let me know.

The Sad Case of Dr. Calloway

Dr. Jesse Calloway, an aged inmate of the county poor farm at Spangle, was taken to Spokane Monday night to be examined as to his sanity and he was sent to the Medical Lake asylum on Wednesday.

Dr. Calloway is over 80 years old and is impressed with the notion that somebody is trying to kill him. At times he is very violent.

For many years Dr. Calloway was a resident of Cheney. He became old and as he had no money and no relatives to take care of him he was finally compelled to go to the poor farm. His mind has been affected for a long time but he has been harmless until lately. He is very infirm, and is not long for this world.

From the census records, Henry C. Callaway was born in Indiana and spent his life in Madison Co., Indiana. His father was Beniah Callaway, physician, born about 1824 in Indiana and died in 1899. Beniah's father was born in OH. Henry is listed on the 1850 Marion Co., IN census and on the 1860-1910 Madison Co., IN census. He died in 1919. Can anyone identify this family line? They are "Mystery Callaways".

The Anderson Trust Company, which conducts a general trust company and banking business at the southeast corner of Tenth and Meridian streets, was established in February, 1899, with a capital stock of $50,000. Since it commenced business the company has increased its capital stock to $100,000, accumulated a fund of over $50,000 in surplus and undivided profits, and in June 1913, carried deposits of nearly $362,000. The present officers of the company are: Sanford M. Keltner, president; Thomas B. Orr, vice-president; Frank H. Schlater, secretary; B. B. McCandliss, assistant secretary. Besides the three principal officers, the board of directors includes J. L. Vermillion, A. J. Brunt, Henry C. Callaway and James M. Donnelly. William H. Heritage is in charge of the real estate and insurance department.

In Elwood, the second city of the county, there are four banks. The oldest of these is the Citizens' State Bank, which was organized in 1881 by B. T. and H. C. Callaway (Editor's Note - This is Beniah and Henry C. Callaway), with a capital of $50,000. In 1908 it was incorporated under the laws of Indiana. Originally it was known as the Citizens' Exchange Bank, but at the time of the incorporation took its present name. The officers in 1913 were: H. C. Callaway, president; S. C. Spoor, vice -president; Charles Osborn, cashier. H. C. Callaway, S. C. Spoor, L. M. Gross, J. W. Callaway (Editor's Note - this is probably John W. Callaway, born about 1854, Henry's brother) and Charles Osborn constitute the board of directors.

The Commercial Bank and Trust Company, of Alexandria, was first organized in 1893 by S. V. Free and Dr. B. T. Callaway as the Commercial Bank. In 1908 it was incorporated as the Commercial State Bank, and in 1912 was reorganized as the Commercial Bank and Trust Company. The capital of this institution is $25,000; its surplus, about $3,500, and its deposits, nearly $175,000. Arthur E. Harlan is president; Harry M. Adams, vice-president; Vernon H. Day, secretary; Hugh A. Harlan, assistant secretary. The board of directors is composed of the three principal officers, J. C. Vinson, S. P. Brown and W. F. Wilson.

On the 16th of September, 1908, Mr. Fred B. Fornshell married Miss Lola B. Callaway, daughter of John W. and Elizabeth (Cochran) Callaway. Mrs. Fornshell is a native of Elwood, where her parents were also born. Mr. John W. Callaway is a banker, farmer and stockman and one of the best known residents in this portion of Madison county. The three children now living in the Callaway family are Arthur B., Charles A., and Lola B. Mrs. Fornshell is a member of the Christian church, while her husband is a Presbyterian. He is affiliated with Quincy Lodge No. 230 A. F. & A. M. and with Elwood Lodge No. 368 of the Order of Elks. In politics he is a Republican.

The next Odd Fellows' lodge to be established in the county was Quincy Lodge, No. 200, which was instituted at Elwood (then Quincy) on July 30, 1858, with twelve charter members and the following officers: Culpepper Lee, noble grand; John B. Frazier, vice-grand; B. T. Callaway, secretary; mark Simmons, treasurer. This lodge now has a membership of about four hundred and owns one of the best halls in the county. Roy F. Mossy was noble grand and Ephraim Remmel was secretary at the end of the year 1912.

Dr. Robert Douglass was the first man to practice medicine in what is now the city of Elwood, having located there twelve years before the town was laid out. Sometime in the 1840s Dr. J. M. Dehority located in that vicinity and engaged in the general practice of medicine. He accumulated a fortune and during the last fifteen years of his life was engaged in the banking business. Dr. John Beck and his son Thomas were also practicing physicians of Elwood. Dr. Beniah T. Callaway first began practice in Alexandria in 1848, but a year later removed to Elwood, where he practiced for thirty-nine years. He was also interested in banking operations.
